About FOI Exceptions

Under Executive Order No. 2, s. 2016, Section 4, certain types of information are exempt from mandatory disclosure to protect national security, privacy, and other legitimate interests. Below are the categories of exceptions that may be cited if a request is denied.

EO 2, Section 4 - Exceptions

Information classified as national security matter under existing laws and rules, the disclosure of which could pose a threat to the national security of the Philippines.

Information concerning the conduct of foreign affairs.

Information regarding inter-government or intra-government exchanges prior to the conclusion of a treaty or executive agreement; recommendations and other communications of government agencies relating to the formulation of policy.

Information compiled for law enforcement purposes where disclosure could reasonably be expected to interfere with enforcement proceedings.

Information, including research or work papers, that if disclosed, could reveal trade secrets or infringe upon intellectual property rights.

Banking, tax, and confidential financial records as defined by law.

Personal information that if disclosed would constitute a clearly unwarranted invasion of personal privacy, as protected under the Data Privacy Act of 2012 (RA 10173).
